Facts: On 18 June 1988, Lt. Candido Quijardo, a Philippine Constabulary officer connected with the 152nd PC Company at Lingayen, Pangasinan, and some companions were sent to verify the presence of CPP/NPA members in Barangay Catacdang, Arellano-Bani, Dagupan City. In said place, the group apprehended Gregorio Flameniano, Berlina Aritumba, Revelina Gamboa and Deogracias Mayaoa. When interrogated, the persons apprehended revealed that there was an underground safehouse at Gracia Village in Urdaneta, Pangasinan. After coordinating with the Station Commander of Urdaneta, the group proceeded to the house in Gracia Village. They found subversive documents, a radio, a 1 x 7 caliber .45 firearm and other items.
After the raid, the group proceeded to Bonuan, Dagupan City, and put under surveillance the rented apartment of Rosemarie Aritumba, sister of Berlina Aritumba whom they earlier arrested. They interviewed Luzviminda Morados, a visitor of Rosemarie Aritumba. She stated that she worked with Bernie Mendoza/Basilio Damaso. She guided the group to the house rented by Damaso (@Mendoza). When they reached the house, the group found that it had already vacated by the occupants. Since Morados was hesitant to give the new address of Damaso (@Mendoza), the group looked for the Barangay Captain of the place and requested him to point out the new house rented by Damaso (@Mendoza).

The group again required Morados to go with them. When they reached the house, the group saw Luz Tanciangco outside. They told her that they already knew that she was a member of the NPA in the area. At first, she denied it, but when she saw Morados she requested the group to go inside the house. Upon entering the house, the group, as well as the Barangay Captain, saw radio sets, pamphlets entitled "Ang Bayan," xerox copiers and a computer machine. They also found persons who were companions of Luz Tanciangco (namely, Teresita Calosa, Ricardo Calosa, Marites Calosa, Eric Tanciangco and Luzviminda Morados).

The group requested the persons in the house to allow them to look around. When Luz Tanciangco opened one of the rooms, they saw books used for subversive orientation, one M-14 rifle, bullets and ammunitions, Kenwood radio, artificial beard, maps of the Philippines, Zambales, Mindoro and Laguna and other items. They confiscated the articles and brought them to their headquarters for final inventory. They likewise brought the persons found in the house to the headquarters for investigation. Said persons revealed that Damaso (@Mendoza) was the lessee of the house and owned the items confiscated therefrom. Thus, Basilio Damaso, was originally charged in an information filed before the Regional Trial Court of Dagupan City with violation of Presidential Decree 1866 in furtherance of, or incident to, or in connection with the crime of subversion, together with Luzviminda Morados y Galang @ Ka Mel, Teresita Calosa y Macabangon @ Ka Tessie, Ricardo Calosa y Perez @ Ka Ric, Marites Calosa y Evangelista @ Ka Tess, Eric Tanciangco y Capira @ Ka Ric and Luz Tanciangco y Pencial @ Ka Luz.

Such information was later amended to exclude all other persons except Damaso from the criminal charge. Upon arraignment, Damaso pleaded not guilty to the crime charged. Trial on the merits ensued. The prosecution rested its case and offered its exhibits for admission. The defense counsel interposed his objections to the admissibility of the prosecution's evidence on grounds of its being hearsay, immaterial or irrelevant and illegal for lack of a search warrant; and thereafter, manifested that he was not presenting any evidence for the accused. On 17 January 1990, the trial court rendered its decision, finding Damaso guilty beyond reasonable doubt, sentencing the latter to suffer the penalty of Reclusion Perpetua and to pay the costs of the proceedings. Damaso appealed.

Issue: Whether there was waiver on the part of Damaso to allow the warrantless search of his house.

Ratio: Damaso was singled out as the sole violator of PD 1866, in furtherance of, or incident to, or in connection with the crime of subversion. There is no substantial and credible evidence to establish the fact that the appellant is allegedly the same person as the lessee of the house where the M-14 rifle and other subversive items were found or the owner of the said items. Even assuming for the sake of argument that Damaso is the lessee of the house, the case against him still will not prosper, the reason being that the law enforcers failed to comply with the requirements of a valid search and seizure proceedings. The constitutional immunity from unreasonable searches and seizures, being a personal one cannot he waived by anyone except the person whose rights are invaded or one who is expressly authorized to do so in his or her . The records show that Damaso was not in his house at that time Luz Tanciangco and Luz Morados, his alleged helper, allowed the authorities to enter it. There is no evidence that would establish the fact that Luz Morados was indeed Damaso's helper or if it was true that she was his helper, that Damaso had given her authority to open his house in his absence. The prosecution likewise failed to show if Luz Tanciangco has such an authority. Without this evidence, the authorities' intrusion into Damaso's dwelling cannot be given any color of legality. While the power to search and seize is necessary to the public welfare, still it must be exercised and the law enforced without transgressing the constitutional rights of the citizens, for the enforcement of no statute is of sufficient importance to justify indifference to the basic principles of government. As a consequence, the search conducted by the authorities was illegal. It would have been different if the situation here demanded urgency which could have prompted the authorities to dispense with a search warrant. But the record is silent on this point. The fact that they came to Damaso's house at nighttime, does not grant them the license to go inside his house.

Ruling: ACCORDINGLY, the decision appealed from is hereby REVERSED and the appellant is ACQUITTED with costs de oficio.

BIDIN, J.:

Facts: On 14 August 1987, Andre Marti and his common-law wife, Shirley Reyes, went to the booth of the Manila Packing and Export Forwarders in the Pistang Pilipino Complex, Ermita, Manila, carrying with them 4 gift-wrapped packages. Anita Reyes (the proprietress and no relation to Shirley Reyes) attended to them. Marti informed Anita Reyes that he was sending the packages to a friend in Zurich, Switzerland. Marti filled up the contract necessary for the transaction, writing therein his name, passport number, the date of shipment and the name and address of the consignee, namely, "WALTER FIERZ, Mattacketr II, 8052 Zurich, Switzerland." Anita Reyes did not inspect the packages as Marti refused, who assured the former that the packages simply contained books, cigars, and gloves and were gifts to his friend in Zurich. In view of Marti's representation, the 4 packages were then placed inside a brown corrugated box, with styro-foam placed at the bottom and on top of the packages, and sealed with masking tape. Before delivery of Marti's box to the Bureau of Customs and/or Bureau of Posts, Mr. Job Reyes (proprietor) and husband of Anita (Reyes), following standard operating procedure, opened the boxes for final inspection, where a peculiar odor emitted therefrom. Job pulled out a cellophane wrapper protruding from the opening of one of the gloves, and took several grams of the contents thereof. Job Reyes forthwith prepared a letter reporting the shipment to the NBI and requesting a laboratory examination of the samples he extracted from the cellophane wrapper. At the Narcotics Section of the National Bureau of Investigation (NBI), the box containing Marti's packages was opened, yielding dried marijuana leaves, or cake-like (bricks) dried marijuana leaves. The NBI agents made an inventory and took charge of the box and of the contents thereof, after signing a "Receipt" acknowledging custody of the said effects. Thereupon, the NBI agents tried to locate Marti but to no avail, inasmuch as the latter's stated address was the Manila Central Post Office. Thereafter, an Information was filed against Marti for violation of RA 6425, otherwise known as the Dangerous Drugs Act. After trial, the Special Criminal Court of Manila (Regional Trial Court, Branch XLIX) rendered the decision, convicting Marti of violation of Section 21 (b), Article IV in relation to Section 4, Article 11 and Section 2 (e)(i), Article 1 of Republic Act 6425, as amended, otherwise known as the Dangerous Drugs Act. Marti appealed.

Issue: Whether an act of a private individual, allegedly in violation of the accused's constitutional rights, be invoked against the State.

Ratio: In the absence of governmental interference, the liberties guaranteed by the Constitution cannot be invoked against the State. The contraband herein, having come into possession of the Government without the latter transgressing the accused's rights against unreasonable search and seizure, the Court sees no cogent reason why the same should not be admitted against him in the prosecution of the offense charged. The mere presence of the NBI agents did not convert the reasonable search effected by Reyes into a warrantless search and seizure proscribed by the Constitution. Merely to observe and look at that which is in plain sight is not a search. Having observed that which is open, where no trespass has been committed in aid thereof, is not search. Where the contraband articles are identified without a trespass on the part of the arresting officer, there is not the search that is prohibited by the constitution. The constitutional proscription against unlawful searches and seizures therefore applies as a restraint directed only against the government and its agencies tasked with the enforcement of the law. Thus, it could only be invoked against the State to whom the restraint against arbitrary and unreasonable exercise of power is imposed. If the search is made upon the request of law enforcers, a warrant must generally be first secured if it is to pass the test of constitutionality. However, if the search is made at the behest or initiative of the proprietor of a private establishment for its own and private purposes, as in the case at bar, and without the intervention of police authorities, the right against unreasonable search and seizure cannot be invoked for only the act of private individual, not the law enforcers, is involved. In sum, the protection against unreasonable searches and seizures cannot be extended to acts committed by private individuals so as to bring it within the ambit of alleged unlawful intrusion by the government.

Ruling: WHEREFORE, the judgment of conviction finding appellant guilty beyond reasonable doubt of the crime charged is hereby AFFIRMED. No costs.

Summary: RTC rendered a Decision denying the petition for mandamus. The RTC upheld all the arguments of the respondents, including their right to deny the sought after mayors permit unless they were duly satisfied that the subject property has been classified as commercial in nature. The Decision made no reference to the application for a writ of preliminary mandatory injunction.

CA dismissed the Petition for Certiorari, ruling that the RTC did not commit any grave abuse of discretion in impliedly denying the application for preliminary mandatory injunction.

TINGA, J.:

Facts: Petitioners operate and run Bombo Radyo DZNC Cauayan (DZNC), an AM radio broadcast station, and Star FM DWIT Cauayan, an FM radio broadcast station, in Cauayan Citry, Isabela. Back in 1996, Newsounds commenced relocation of its broadcasting station, management office, and transmitters on propery located in Minante 2, Cauayan City, Isabela.

On July 1996, the Housing & Land Use Regulatory Board (HLURB) and Office of the Municipal Planning and Development Coordinator (OMPDC) affirmed and certified that the commercial structure to be constructed conformed to local zoning regulations, noting as well that the location is classified as a “commercial area”. The radio station was able to fully operate smoothly thereafter.

In 2002 however, when petitioners applied for a renewal of mayors permit, City Zoning Administratior-Designate Bagnos Maximo refused to issue zoning clearance on the grounds that petitioners were not able to submit conversion papers showing that the agricultural land was converted to commercial land. Petitioners asked the court to compel the issuance of mayors permit but the court denied the action. In the meantime, the Department of Agrarian Reform (DAR) Region II office issued to petitioners a formal recognition of conversion of the property from agricultural to commercial.

In 2003, petitioners again filed their application for renewal of mayors permit, attaching the DAR Order. Respondent Felicisimo Meer, acting City Administrator of Cauayan City denied the same, claiming that it was void on the grounds that they did not have record of the DAR Order.

The deadline lapsed on Febuary 15, 2004, and respondents Meer and Racma Fernandez-Garcia, City Legal Officer of Cauayan City, closed the radio station. Due to the prvosion of Omnibus Election Code which prohibits the closure of radio station during the pendency of election period, COMELEC issued an order allowing the petitioners to operate before Febuary 17, 2004, but was barred again by respondent Mayor Ceasar Dy on the grounds that the radio station had no permit. Nonetheless, COMELEC allowed them to run again until June 10, 2004 after elections. Petitioners filed the case to the RTC and CA for the issuance of mayors permit but both courts denied the petition.

A municipal or city mayor is likewise authorized under the LGC to issue licenses and permits, and suspend or revoke the same for any violation of the conditions upon which said licenses or permits had been issued, pursuant to law or ordinance. In case of Cauayan City, the authority to require a mayors permit was enacted through Ordinance No. 92-004, enacted in 1993. However, nothing in the ordinance requires an application for a mayors permit to submit “either an approved land conversion papers from DAR, showing that its property was converted from prime agricultural land or an approved resolution from the Sangguniang Bayan or Sangguniang Panglungsod authorizing the reclassification of property from agricultural to commercial land.

In 1996, the HLURB issued a zoning decision that classified the property as commercial. Petitioners are also armed with several certifications stating that the property is indeed a commercial area. Also, petitioners paid real property taxes based on the classification of property as commercial without objections raised by the respondents.

Petitioners argued that this consistent recognition by the local government of Cauayan of the commercial character of the property constitutes estoppels against respondents from denying the fact before the courts. The lower courts had ruled that “the government of Cauayan City is not bound by estoppels, but petitioners classified that this concept is understood to only refer to acts and mistakes of its official especially to those which are irregular.

Issue: WON there is prior restraint against DZNC

Ratio: YES.

Petitioners have taken great pains to depict their struggle as a textbook case of denial of the right to free speech and of the press. In their tale, there is undeniable political color. They admit that in 2001, Bombo Radyo was aggressive in exposing the widespread election irregularities in Isabela that appear to have favored respondent Dy and other members of the Dy political dynasty. Respondent Ceasar Dy is the brother of Faustino Dy, Jr., governor of Isabela from 2001 until he was defeated in his re-election bid in 2004 by Grace Padaca, a former assistant station manager at petitioners own DZNC Bombo Radyo. A rival AM radio station in Cauayan City, DWDY, is owned and operated by the Dy family. Petitioners likewise direct our attention to a 20 February 2004 article printed in the Philippine Daily Inquirer where Dy is quoted as intending to file disenfranchisement proceedings against DZNC-AM.

The partisan component of this dispute will no doubt sway many observers towards one opinion or the other, but not us. The comfort offered by the constitutional shelter of free expression is neutral as to personality, affinity, ideology and popularity. The judges tasked to enforce constitutional order are expected to rule accordingly from the comfort of that neutral shelter.

The following undisputed facts bring the issue of free expression to fore. Petitioners are authorized by law to operate radio stations in Cauayan City, and had been doing so for some years undisturbed by local authorities. Beginning in 2002, respondents in their official capacities have taken actions, whatever may be the motive, that have impeded the ability of petitioners to freely broadcast, if not broadcast at all. These actions have ranged from withholding permits to operate to the physical closure of those stations under color of legal authority. While once petitioners were able to broadcast freely, the weight of government has since bore down upon them to silence their voices on the airwaves. An elementary school child with a basic understanding of civics lessons will recognize that free speech animates these cases.

Without taking into account any extenuating circumstances that may favor the respondents, we can identify the bare acts of closing the radio stations or preventing their operations as an act of prior restraint against speech, expression or of the press. Prior restraint refers to official governmental restrictions on the press or other forms of expression in advance of actual publication or dissemination. While any system of prior restraint comes to court bearing a heavy burden against its constitutionality, not all prior restraints on speech are invalid.

That the acts imputed against respondents constitute a prior restraint on the freedom of expression of respondents who happen to be members of the press is clear enough. There is a long-standing tradition of special judicial solicitude for free speech, meaning that governmental action directed at expression must satisfy a greater burden of justification than governmental action directed at most other forms of behavior. We had said in SWS v. COMELEC: Because of the preferred status of the constitutional rights of speech, expression, and the press, such a measure is vitiated by a weighty presumption of invalidity. Indeed, any system of prior restraints of expression comes to this Court bearing a heavy presumption against its constitutional validity. . . . The Government 'thus carries a heavy burden of showing justification for the enforcement of such restraint. There is thus a reversal of the normal presumption of validity that inheres in every legislation.

At the same time, jurisprudence distinguishes between  a content-neutral regulation, i.e., merely concerned with the incidents of the speech, or one that merely controls the time, place or manner, and under well defined standards; and a content-based  restraint or censorship, i.e., the restriction is based on the subject matter of the utterance or speech. Content-based laws are generally treated as more suspect than content-neutral laws because of judicial concern with discrimination in the regulation of expression.[44] Content-neutral regulations of speech or of conduct that may amount to speech, are subject to lesser but still heightened scrutiny.

Ostensibly, the act of an LGU requiring a business of proof that the property from which it operates has been zoned for commercial use can be argued, when applied to a radio station, as content-neutral since such a regulation would presumably apply to any other radio station or business enterprise within the LGU.

However, the circumstances of this case dictate that we view the action of the respondents as a content-based restraint.

35.3. The timing of respondents closure of petitioners radio stations is also very telling. The closure comes at a most critical time when the people are set to exercise their right of suffrage. Such timing emphasizes the ill motives of respondents.

In their Answer with Comment to the petition for mandamus, respondents admitted that petitioners had made such exposes during the 2001 elections, though they denied the nature and truthfulness of such reports. They conceded that the Philippine Daily Inquirer story reported that Dy said he planned to file disenfranchisement proceedings against [DZNC]-AM. While respondents assert that there are other AM radio stations in Isabela, they do not specifically refute that station DWDY was owned by the Dy family, or that DZNC and DWDY are the two only stations that operate out of Cauayan.

Prior to 2002, petitioners had not been frustrated in securing the various local government requirements for the operation of their stations. It was only in the beginning of 2002, after the election of respondent Ceasar Dy as mayor of Cauayan, that the local government started to impose these new requirements substantiating the conversion of CDCs property for commercial use. Petitioners admit that during the 2001 elections, Bombo Radyo was aggressive in exposing the widespread election irregularities in Isabela that appear to have favored Respondent Dy and other members of the Dy political dynasty.[52] Respondents efforts to close petitioners radio station clearly intensified immediately before the May 2004 elections, where a former employee of DZNC Bombo Radyo, Grace Padaca, was mounting a credible and ultimately successful challenge against the incumbent Isabela governor, who happened to be the brother of respondent Dy. It also bears notice that the requirements required of petitioners by the Cauayan City government are frankly beyond the pale and not conventionally adopted by local governments throughout the Philippines.

All those circumstances lead us to believe that the steps employed by respondents to ultimately shut down petitioners radio station were ultimately content-based. The United States Supreme Court generally treats restriction of the expression of a particular point of view as the paradigm violation of the First Amendment.[53] The facts confronting us now could have easily been drawn up by a constitutional law professor eager to provide a plain example on how free speech may be violated.

The Court is of the position that the actions of the respondents warrant heightened or strict scrutiny from the Court, the test which we have deemed appropriate in assessing content-based restrictions on free speech, as well as for laws dealing with freedom of the mind or restricting the political process, of laws dealing with the regulation of speech, gender, or race as well as other fundamental rights as expansion from its earlier applications to equal protection.[54] The immediate implication of the application of the strict scrutiny test is that the burden falls upon respondents as agents of government to prove that their actions do not infringe upon petitioners constitutional rights. As content regulation cannot be done in the absence of any compelling reason,[55] the burden lies with the government to establish such compelling reason to infringe the right to free expression.

Ruling: WHEREFORE, the petitions are GRANTED. The assailed decisions of the Court of Appeals and the Regional Trial Court of Cauayan City, Branch 24, are hereby REVERSED and SET ASIDE. The instant petition for mandamus is hereby GRANTED and respondents are directed to immediately issue petitioners zoning clearances and mayors permits for 2004 to petitioners

Notes: Whenever the force of government or any of its political subdivisions bears upon to close down a private broadcasting station, the issue of free speech infringement cannot be minimized, no matter the legal justifications offered for the closure. In many respects, the present petitions offer a textbook example of how the constitutional guarantee of freedom of speech, expression and of the press may be unlawfully compromised. Tragically, the lower courts involved in this case failed to recognize or assert the fundamental dimensions, and it is our duty to reverse, and to affirm the Constitution and the most sacred rights it guarantees.

Facts: Petitioner McElroy an Australian film maker, and his movie production company, Ayer Productions, envisioned, sometime in 1987, for commercial viewing and for Philippine and international release, the historic peaceful struggle of the Filipinos at EDSA. The proposed motion picture entitled "The Four Day Revolution" was endorsed by the MTRCB as and other government agencies consulted. Ramos also signified his approval of the intended film production.

It is designed to be viewed in a six-hour mini-series television play, presented in a "docu-drama" style, creating four fictional characters interwoven with real events, and utilizing actual documentary footage as background. David Williamson is Australia's leading playwright and Professor McCoy (University of New South Wales) is an American historian have developed a script.

Enrile declared that he will not approve the use, appropriation, reproduction and/or exhibition of his name, or picture, or that of any member of his family in any cinema or television production, film or other medium for advertising or commercial exploitation. petitioners acceded to this demand and the name of Enrile was deleted from the movie script, and petitioners proceeded to film the projected motion picture. However, a complaint was filed by Enrile invoking his right to privacy. RTC ordered for the desistance of the movie production and making of any reference to plaintiff or his family and from creating any fictitious character in lieu of plaintiff which nevertheless is based on, or bears substantial or marked resemblance to Enrile. Hence the appeal.

Issue: Whether or Not freedom of expression was violated.

Ratio: Yes. Freedom of speech and of expression includes the freedom to film and produce motion pictures and exhibit such motion pictures in theaters or to diffuse them through television. Furthermore the circumstance that the production of motion picture films is a commercial activity expected to yield monetary profit, is not a disqualification for availing of freedom of speech and of expression.

The projected motion picture was as yet uncompleted and hence not exhibited to any audience. Neither private respondent nor the respondent trial Judge knew what the completed film would precisely look like. There was, in other words, no "clear and present danger" of any violation of any right to privacy. Subject matter is one of public interest and concern. The subject thus relates to a highly critical stage in the history of the country.

At all relevant times, during which the momentous events, clearly of public concern, that petitioners propose to film were taking place, Enrile was a "public figure:" Such public figures were held to have lost, to some extent at least, their right to privacy.

The line of equilibrium in the specific context of the instant case between the constitutional freedom of speech and of expression and the right of privacy, may be marked out in terms of a requirement that the proposed motion picture must be fairly truthful and historical in its presentation of events.

Ruling: WHEREFORE,

a) the Petitions for Certiorari are GRANTED DUE COURSE, and the Order dated 16 March 1988 of respondent trial court granting a Writ of Preliminary Injunction is hereby SET ASIDE. The limited Temporary Restraining Order granted by this Court on 24 March 1988 is hereby MODIFIED by enjoining unqualifiedly the implementation of respondent Judge's Order of 16 March 1988 and made PERMANENT, and

b) Treating the Manifestations of petitioners dated 30 March 1988 and 4 April 1988 as separate Petitions for Certiorari with Prayer for Preliminary Injunction or Restraining Order, the Court, in the exercise of its plenary and supervisory jurisdiction, hereby REQUIRES Judge Teofilo Guadiz of the Regional Trial Court of Makati, Branch 147, forthwith to DISMISS Civil Case No. 88-413 and accordingly to SET ASIDE and DISSOLVE his Temporary Restraining Order dated 25 March 1988 and any Preliminary Injunction that may have been issued by him.

No pronouncement as to costs.

SO ORDERED.

Facts: A 19-year-old department store worker expressed his opposition to the Vietnam War by wearing a jacket emblazoned with "FUCK THE DRAFT. STOP THE WAR" The young man, Paul Cohen, was charged under a California statute that prohibits "maliciously and willfully disturb[ing] the peace and quiet of any neighborhood or person [by] offensive conduct." Cohen was found guilty and sentenced to 30 days in jail.

Issue: WON California's statute, prohibiting the display of offensive messages such as "Fuck the Draft," violate freedom of expression as protected by the First Amendment?

Ratio: Yes. In an opinion by Justice John Marshall Harlan, the Court reasoned that the expletive, while provocative, was not directed toward anyone; besides, there was no evidence that people in substantial numbers would be provoked into some kind of physical action by the words on his jacket. Harlan recognized that "one man's vulgarity is another's lyric." In doing so, the Court protected two elements of speech: the emotive (the expression of emotion) and the cognitive (the expression of ideas).

The Court, by a vote of 5-4, per Justice John Marshall Harlan II, overturned the appellate court's ruling. First, Justice Harlan began by emphasizing that this case concerned "speech", and not "conduct", as was at issue in United States v. O'Brien. Harlan then stated that any attempt by California to abridge the content of Cohen's speech would be no doubt unconstitutional except in a few instances, like, for example, if California was regulating the time, place, or manner of Cohen's speech independent from the content of the speech.

Second, Harlan also expressed the concern of the Court that section 415 was vague and did not put citizens on notice as to what behavior was unlawful. Indeed, the words "offensive conduct" alone cannot "be said sufficiently to inform the ordinary person that distinctions between certain locations are thereby created."

Third, the mere use of an untoward four-letter word did not place the speech into a category of speech that has traditionally been subject to greater regulations by the government, as in Roth v. United States, for example. Similarly, Harlan and the Court refused to categorize the speech at issue as a "fighting word" under Chaplinsky v. New Hampshire, because no "individual actually or likely to be present could reasonably have regarded the words on appellant's jacket as a direct personal insult." Finally, the Court was unwilling to give credence to the idea that the government could suppress the type of speech at issue here in order to protect the public at large.

Having discarded what was not at issue in this case, Harlan stated that the issue was "whether California can excise, as "offensive conduct", one particular scurrilous epithet from the public discourse, either upon the theory...that its use is inherently likely to cause violent reaction or upon a more general assertion that the States, acting as guardians of public morality, may properly remove this offensive word from the public vocabulary."

The states could not. As to the first theory, the Court stated that it was not presented with any evidence suggesting that the speech was likely to cause an incitement to violence. As to the second theory, the Court stated that while it was a closer call, the rationale was not sufficient.

Specifically, Harlan, citing Justice Brandeis' opinion in Whitney v. California, emphasized that the First Amendment operates to protect the inviolability of the marketplace of ideas imagined by the Founding Fathers. Allowing California to suppress the speech at issue in this case would be destructive to that marketplace.

"To many, the immediate consequence of this freedom may often appear to be only verbal tumult, discord, and even offensive utterance", Justice Harlan wrote. "These are, however, within established limits, in truth necessary side effects of the broader enduring values which the process of open debate permits us to achieve. That the air may at times seem filled with verbal cacophony is, in this sense not a sign of weakness but of strength."[2]

"[A]bsent a more particularized and compelling reason for its actions", Harlan continued, "the State may not, consistently with the First and Fourteenth Amendments, make the simple public display of this single four-letter expletive a criminal offense."[3] In his opinion Justice Harlan famously wrote "one man's vulgarity is another's lyric."[4]

Thus, Harlans arguments can be constructed in three major points: First, states (California) cannot censor their citizens in order to make a “civil” society. Second, knowing where to draw the line between harmless heightened emotion and vulgarity can be difficult. Third, people bring passion to politics and vulgarity is simply a side effect of a free exchange of ideas—no matter how radical they may be.

Ruling: It is, in sum, our judgment that, absent a more particularized and compelling reason for its actions, the State may not, consistently with the First and Fourteenth Amendments, make the simple public display here involved of this single four-letter expletive a criminal offense. Because that is the only arguably sustainable rationale for the conviction here at issue, the judgment below must be REVERSED.

Every person who maliciously and willfully disturbs the peace or quiet of any neighborhood or person, by loud or unusual noise, or by tumultuous or offensive conduct, or threatening, traducing, quarreling, challenging to fight, or fighting, or who, on the public streets of any unincorporated town, or upon the public highways in such unincorporated town, run any horse race, either for a wager or for amusement, or fire any gun or pistol in such unincorporated town, or use any vulgar, profane, or indecent language within the presence or hearing of women or children, in a loud and boisterous manner, is guilty of a misdemeanor, and upon conviction by any Court of competent jurisdiction shall be punished by fine not exceeding two hundred dollars, or by imprisonment in the County Jail for not more than ninety days, or by both fine and imprisonment, or either, at the discretion of the Court.

The suggestion has been made that, in light of the supervening opinion of the California Supreme Court in In re Bushman, 1 Cal.3d 767, 463 P.2d 727 (1970), it is "not at all certain that the California Court of Appeal's construction of § 415 is now the authoritative California construction." Post at 27 (BLACKMUN, J., dissenting). In the course of the Bushman opinion, Chief Justice Traynor stated:

[One] may . . . be guilty of disturbing the peace through "offensive" conduct [within the meaning of § 415] if, by his actions, he willfully and maliciously incites others to violence or engages in conduct likely to incite others to violence. (People v. Cohen (1969) 1 Cal.App.3d 94, 101, [81 Cal.Rptr. 503].)

We perceive no difference of substance between the Bushman construction and that of the Court of Appeal, particularly in light of the Bushman court's approving citation of Cohen.

It is illuminating to note what transpired when Cohen entered a courtroom in the building. He removed his jacket and stood with it folded over his arm. Meanwhile, a policeman sent the presiding judge a note suggesting that Cohen be held in contempt of court. The judge declined to do so, and Cohen was arrested by the officer only after he emerged from the courtroom. App. 119.

In fact, other portions of the same statute do make some such distinctions. For example, the statute also prohibits disturbing "the peace or quiet . . . by loud or unusual noise" and using "vulgar, profane, or indecent language within the presence or hearing of women or children, in a loud and boisterous manner." See n. 1, supra. This second-quoted provision in particular serves to put the actor on much fairer notice as to what is prohibited. It also buttresses our view that the "offensive conduct" portion, as construed and applied in this case, cannot legitimately be justified in this Court as designed or intended to make fine distinctions between differently situated recipients.

The amicus urges, with some force, that this issue is not properly before us, since the statute, as construed, punishes only conduct that might cause others to react violently. However, because the opinion below appears to erect a virtually irrebuttable presumption that use of this word will produce such results, the statute, as thus construed, appears to impose, in effect, a flat ban on the public utterance of this word. With the case in this posture, it does not seem inappropriate to inquire whether any other rationale might properly support this result. While we think it clear, for the reasons expressed above, that no statute which merely proscribes "offensive conduct" and has been construed as broadly as this one was below can subsequently be justified in this Court as discriminating between conduct that occurs in different places or that offends only certain persons, it is not so unreasonable to seek to justify its full broad sweep on an alternate rationale such as this. Because it is not so patently clear that acceptance of the justification presently under consideration would render the statute overbroad or unconstitutionally vague, and be cause the answer to appellee's argument seems quite clear, we do not pass on the contention that this claim is not presented on this record.

Facts: Cecilia Maruyama filed a complaint charging Lorna Tanghal and petitioner Teresita Tanghal Okabe, a.k.a. Shiela Okabe, with estafa. Maruyama alleged, that on December 11, 1998, she entrusted Y11,410,000 with the peso equivalent of P3,993,500 to the petitioner, who was engaged in the business of "door-to-door delivery" from Japan to the Philippines. It was alleged that the petitioner failed to deliver the money as agreed upon, and, at first, denied receiving the said amount but later returned only US$1,000 through Lorna Tanghal.

During the preliminary investigation, the complainant submitted the affidavit of her witnesses and other documentary evidence. After the requisite preliminary investigation, 2nd Assistant City Prosecutor Joselito J. Vibandor came out with a resolution, finding probable cause for estafa against the petitioner w/c was subsequently approved by the city prosecutor. The trial court then issued a warrant of arrest with a recommended bond of P40,000. Petitioner posted a personal bail bond in the said amount.

The petitioner left the Philippines for Japan on June 17, 2000 without the trial courts permission, and returned to the Philippines on June 28, 2000. She left the Philippines anew on July 1, 2000, and returned on July 12, 2000. On July 14, 2000, the private prosecutor filed an urgent ex parte motion for the issuance of the hold departure order. Trial court approved the same.

Meanwhile, the petitioner filed a verified motion for judicial determination of probable cause and to defer proceedings/arraignment, alleging that the only documents appended to the Information submitted by the investigating prosecutor were respondent Maruyamas affidavit-complaint for estafa and the resolution of the investigating prosecutor; the affidavits of the witnesses of the complainant, the respondents counter-affidavit and the other evidence adduced by the parties were not attached thereto.

On July 19, 2000, the petitioner also filed a Very Urgent Motion To Lift/Recall Hold Departure Order dated July 17, 2000 and/or allow her to regularly travel to Japan for the reason that she have 3 minor children residing there relying on her for support. Petitioner also questioned the irregularity of the determination of probable cause during the preliminary investigation however the respondent judge ruled that the posting of bail and the filing motions for relief estopped the petitioner from questioning the same. Upon arraignment, petitioner refused to enter a plea and w/ leave of court left the court room. Petitioner filed w/ CA a petition for Certiorari. CA set aside the hold departure order however all the other motions were denied, hence this case.

Issue: WON the respondent judge committed a reversible error in determining existence of probable cause despite lack of affidavits of the witnesses of respondent Maruyama and the latters documentary evidence, as well as the counter-affidavit of the petitioner.

Ratio: Yes, the rulings of this Court are now embedded in Section 8(a), Rule 112 of the Revised Rules on Criminal Procedure which provides that:

SEC. 8. Records. – (a) Records supporting the information or complaint. An information or complaint filed in court shall be supported by the affidavits and counter-affidavits of the parties and their witnesses, together with the other supporting evidence and the resolution on the case. The respondent judge is hereby DIRECTED to determine the existence or non-existence of probable cause for the arrest of the petitioner based on the complete records, as required under Section 8(a), Rule 112 of the Revised Rules on Criminal Procedure.


In determining the existence or non-existence of probable cause for the arrest of the accused, the judge should not rely solely on the said report. [The judge should consider not only the report of the investigating prosecutor but also the affidavit/affidavits and the documentary evidence of the parties, the counter-affidavit of the accused and his witnesses, as well as the transcript of stenographic notes taken during the preliminary investigation, if any, submitted to the court by the investigating prosecutor upon the filing of the Information. The duty to make such determination is personal and exclusive to the issuing judge. He cannot abdicate his duty and rely on the certification of the investigating prosecutor that he had conducted a preliminary investigation in accordance with law and the Rules of Court, as amended, and found probable cause for the filing of the Information.

The task of the presiding judge when the Information is filed with the court is first and foremost to determine the existence or non-existence of probable cause for the arrest of the accused. Probable cause is meant such set of facts and circumstances which would lead a reasonably discreet and prudent man to believe that the offense charged in the Information or any offense included therein has been committed by the person sought to be arrested. The purpose of the mandate of the judge to first determine probable cause for the arrest of the accused is to insulate from the very start those falsely charged of crimes from the tribulations, expenses and anxiety of a public trial.

Under Section 6, Rule 112 of the Rules of Court in relation to Section 2, Article III of the 1987 Constitution, the judge must make a personal determination of the existence or non-existence of probable cause for the arrest of the accused.  Under Section 1, Rule 112 of the Rules on Criminal Procedure, the investigating prosecutor, in conducting a preliminary investigation of a case cognizable by the RTC, is tasked to determine whether there is sufficient ground to engender a well-founded belief that a crime has been committed and the respondent therein is probably guilty thereof and should be held for trial. A preliminary investigation is for the purpose of securing the innocent against hasty, malicious and oppressive prosecution, and to protect him from an open and public accusation of a crime, from the trouble, expense and anxiety of a public trial.

If the investigating prosecutor finds probable cause for the filing of the Information against the respondent, he executes a certification at the bottom of the Information that from the evidence presented, there is a reasonable ground to believe that the offense charged has been committed and that the accused is probably guilty thereof. Such certification of the investigating prosecutor is, by itself, ineffective. It is not binding on the trial court. Nor may the RTC rely on the said certification as basis for a finding of the existence of probable cause for the arrest of the accused.


Ruling: The petition is GRANTED. The assailed decision of the Court of Appeals is REVERSED and SET ASIDE. The assailed Orders dated August 25 and 28, 2000 and the Warrant of Arrest issued by the respondent judge in Criminal Case No. 00-0749 are SET ASIDE. The records are REMANDED to the Regional Trial Court of Pasay City, Branch 119. The respondent judge is hereby DIRECTED to determine the existence or non-existence of probable cause for the arrest of the petitioner based on the complete records, as required under Section 8(a), Rule 112 of the Revised Rules on Criminal Procedure.

Facts: On 18 June 1988, Lt. Candido Quijardo, a Philippine Constabulary officer connected with the 152nd PC Company at Lingayen, Pangasinan, and some companions were sent to verify the presence of CPP/NPA members in Barangay Catacdang, Arellano-Bani, Dagupan City. In said place, the group apprehended Gregorio Flameniano, Berlina Aritumba, Revelina Gamboa and Deogracias Mayaoa. When interrogated, the persons apprehended revealed that there was an underground safehouse at Gracia Village in Urdaneta, Pangasinan. After coordinating with the Station Commander of Urdaneta, the group proceeded to the house in Gracia Village. They found subversive documents, a radio, a 1 x 7 caliber .45 firearm and other items.
After the raid, the group proceeded to Bonuan, Dagupan City, and put under surveillance the rented apartment of Rosemarie Aritumba, sister of Berlina Aritumba whom they earlier arrested. They interviewed Luzviminda Morados, a visitor of Rosemarie Aritumba. She stated that she worked with Bernie Mendoza/Basilio Damaso. She guided the group to the house rented by Damaso (@Mendoza). When they reached the house, the group found that it had already vacated by the occupants. Since Morados was hesitant to give the new address of Damaso (@Mendoza), the group looked for the Barangay Captain of the place and requested him to point out the new house rented by Damaso (@Mendoza).

The group again required Morados to go with them. When they reached the house, the group saw Luz Tanciangco outside. They told her that they already knew that she was a member of the NPA in the area. At first, she denied it, but when she saw Morados she requested the group to go inside the house. Upon entering the house, the group, as well as the Barangay Captain, saw radio sets, pamphlets entitled "Ang Bayan," xerox copiers and a computer machine. They also found persons who were companions of Luz Tanciangco (namely, Teresita Calosa, Ricardo Calosa, Marites Calosa, Eric Tanciangco and Luzviminda Morados).

The group requested the persons in the house to allow them to look around. When Luz Tanciangco opened one of the rooms, they saw books used for subversive orientation, one M-14 rifle, bullets and ammunitions, Kenwood radio, artificial beard, maps of the Philippines, Zambales, Mindoro and Laguna and other items. They confiscated the articles and brought them to their headquarters for final inventory. They likewise brought the persons found in the house to the headquarters for investigation. Said persons revealed that Damaso (@Mendoza) was the lessee of the house and owned the items confiscated therefrom. Thus, Basilio Damaso, was originally charged in an information filed before the Regional Trial Court of Dagupan City with violation of Presidential Decree 1866 in furtherance of, or incident to, or in connection with the crime of subversion, together with Luzviminda Morados y Galang @ Ka Mel, Teresita Calosa y Macabangon @ Ka Tessie, Ricardo Calosa y Perez @ Ka Ric, Marites Calosa y Evangelista @ Ka Tess, Eric Tanciangco y Capira @ Ka Ric and Luz Tanciangco y Pencial @ Ka Luz.

Such information was later amended to exclude all other persons except Damaso from the criminal charge. Upon arraignment, Damaso pleaded not guilty to the crime charged. Trial on the merits ensued. The prosecution rested its case and offered its exhibits for admission. The defense counsel interposed his objections to the admissibility of the prosecution's evidence on grounds of its being hearsay, immaterial or irrelevant and illegal for lack of a search warrant; and thereafter, manifested that he was not presenting any evidence for the accused. On 17 January 1990, the trial court rendered its decision, finding Damaso guilty beyond reasonable doubt, sentencing the latter to suffer the penalty of Reclusion Perpetua and to pay the costs of the proceedings. Damaso appealed.

Issue: Whether there was waiver on the part of Damaso to allow the warrantless search of his house.

Ratio: Damaso was singled out as the sole violator of PD 1866, in furtherance of, or incident to, or in connection with the crime of subversion. There is no substantial and credible evidence to establish the fact that the appellant is allegedly the same person as the lessee of the house where the M-14 rifle and other subversive items were found or the owner of the said items. Even assuming for the sake of argument that Damaso is the lessee of the house, the case against him still will not prosper, the reason being that the law enforcers failed to comply with the requirements of a valid search and seizure proceedings. The constitutional immunity from unreasonable searches and seizures, being a personal one cannot he waived by anyone except the person whose rights are invaded or one who is expressly authorized to do so in his or her . The records show that Damaso was not in his house at that time Luz Tanciangco and Luz Morados, his alleged helper, allowed the authorities to enter it. There is no evidence that would establish the fact that Luz Morados was indeed Damaso's helper or if it was true that she was his helper, that Damaso had given her authority to open his house in his absence. The prosecution likewise failed to show if Luz Tanciangco has such an authority. Without this evidence, the authorities' intrusion into Damaso's dwelling cannot be given any color of legality. While the power to search and seize is necessary to the public welfare, still it must be exercised and the law enforced without transgressing the constitutional rights of the citizens, for the enforcement of no statute is of sufficient importance to justify indifference to the basic principles of government. As a consequence, the search conducted by the authorities was illegal. It would have been different if the situation here demanded urgency which could have prompted the authorities to dispense with a search warrant. But the record is silent on this point. The fact that they came to Damaso's house at nighttime, does not grant them the license to go inside his house.

Ruling: ACCORDINGLY, the decision appealed from is hereby REVERSED and the appellant is ACQUITTED with costs de oficio.
